Terms of Use

These Terms explain the conditions for using the FlyWindow website and connected services, together with important product-specific notices for the FlyWindow iPhone app.

FlyWindow is operated by an independent developer based in Ukraine (“FlyWindow”, “we”, “us”). Contact: support@flywindow.app.

1. Terms that apply

Your licence to use the FlyWindow iPhone app is governed by Apple’s Standard Licensed Application End User License Agreement (“Standard EULA”). This page does not replace the Standard EULA. It governs the FlyWindow website and connected services and explains conditions specific to the product.

By using FlyWindow, you agree to the Standard EULA and these Terms. If you do not agree, do not use FlyWindow. If these Terms conflict with the Standard EULA regarding the licence to the app, the Standard EULA controls.

2. What FlyWindow provides

FlyWindow helps users compare forecast weather with limits they select; view daylight weather windows and the conditions behind them; plan sun position and forecast cloud cover; and discover photographic subjects worth scouting.

FlyWindow is a planning aid. Features, coverage and availability may differ by place, time, device, subscription status and third-party data availability.

3. Your decisions and responsibilities

A FlyWindow result means only that the forecast values shown for the stated daylight hours fit, or do not fit, the limits selected in the app. FlyWindow does not grant permission to launch, land or operate a drone and does not replace your own assessment.

You are responsible for checking current official aviation requirements, local restrictions, land access, weather at the location, your aircraft’s condition and documentation, and your own competence before each flight. External official-source links are provided for convenience; verify the current source yourself.

A Photo Spot is a photographic subject worth scouting, not permission to visit private property or operate a drone there.

4. Forecasts, calculations and selected limits

Weather forecasts can change and may be delayed, incomplete, unavailable or inaccurate. Do not use FlyWindow as the sole source for a decision where an error could cause harm to a person or property.

FlyWindow does not fill missing forecast values with estimates. Where required data is unavailable, the app may show No data or withhold a result.

Sun position and light periods are calculated for the selected place and time. Forecast cloud cover and actual light may differ from conditions on location.

Suggested drone-profile limits are editable starting points, not manufacturer ratings. You are responsible for selecting limits appropriate to your aircraft, conditions and use.

5. Third-party data, services and content

FlyWindow relies on services and content provided by third parties, including Apple services for weather, place search and purchases; NOAA for space-weather information; OpenStreetMap and Wikidata for place data; Wikimedia Commons for photographs; and Cloudflare for hosting and moderation services.

Third-party services may be changed, limited, interrupted or withdrawn without notice. Their content may be incomplete or inaccurate. External links and services are governed by their own terms and policies.

Photographs and other third-party content remain the property of their respective rights holders. Where required, FlyWindow displays the author, licence and source link. You may not extract or reuse third-party content except under the terms supplied with that content.

6. FlyWindow Pro and App Store purchases

FlyWindow may offer optional auto-renewing subscriptions through Apple. Available plans, prices, billing periods, trial eligibility and included features are shown in the app before purchase. Prices and availability can vary by country or region.

Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically unless you cancel it through Apple before renewal. If a trial is offered, the purchase screen states its duration and the paid subscription that follows. Apple manages billing, cancellation, Family Sharing eligibility and refund requests.

Deleting FlyWindow does not cancel a subscription. You can manage or cancel a subscription through your Apple subscription settings, restore an eligible purchase from FlyWindow Settings, and request an eligible refund through Apple’s purchase support.

Mandatory consumer rights in your country or region are not limited by these Terms.

7. Acceptable use

You may not interfere with, overload, probe or attempt to bypass FlyWindow’s services or technical protections; submit reports you know are false, abusive or unrelated to the listed place or photograph; use FlyWindow to infringe another person’s rights or violate applicable law; or copy, modify, redistribute or reverse engineer the app except where applicable law or the Standard EULA permits it.

We may restrict access to a connected service when reasonably necessary to protect FlyWindow, its users or third-party providers, or to address misuse.

8. Availability and changes

We may correct, change, suspend or discontinue a feature or connected service. We do not promise that every feature or data source will remain available at all times or in every location.

Cached information may remain visible with its age when a current update is unavailable. You are responsible for checking whether the information is current enough for your intended use.

9. Intellectual property

FlyWindow’s name, interface, original text, graphics and software are protected by applicable intellectual-property laws. The Standard EULA grants the licence to use the app. No other rights are transferred to you.

Third-party names, maps, photographs, data and trademarks belong to their respective owners and are used under their applicable licences or terms.

10. Privacy

The Privacy Policy explains how FlyWindow handles information in the app, connected services and website. There is no FlyWindow account. Apple separately handles App Store purchases and subscription records.

11. Changes to these Terms

We may update these Terms when the product, connected services or legal requirements change. We will change the effective date and provide additional notice where required. Continued use after an update takes effect means the updated Terms apply, subject to applicable law.
